Professional Soldiers Left in Limbo Over New 2026 Tenure Regulations

New labor laws effective in 2026 allow citizens to count self-employment and civil contracts toward seniority benefits, yet professional soldiers remain excluded from these clear statutory advancements, fueling uncertainty within the military.

The 2026 Tenure Reform

As of 2026, Polish labor law has expanded the criteria for calculating professional tenure. Periods of self-employment or work performed under civil law contracts can now be credited toward seniority, impacting entitlements such as leave duration and jubilee awards.

While these changes apply to the public and private sectors, they specifically list various uniformed services under Article 302 of the Labor Code. Notably, professional soldiers serving in the Polish Armed Forces were omitted from this explicit list.

Legal Discrepancies and Military Concerns

The military community is questioning why they remain excluded despite the nature of their service being comparable to other uniformed formations. This has led to concerns among personnel who held previous private-sector careers, as they fear their years of experience will not count toward their military service records.

MP Magdalena Sroka formally addressed this issue in an interpellation to the Ministry of National Defense. She argued that failing to include soldiers alongside other uniformed officers creates an inequality that discourages experienced professionals from joining the ranks.

The Ministry’s Ambiguous Stance

The Ministry of National Defense responded by noting that the military operates under its own legal regime, independent of the Labor Code. They clarified that no immediate legislative changes are planned to align military service regulations with the updated Labor Code.

However, the Ministry simultaneously signaled that it sees no fundamental objection to recognizing non-standard work periods for jubilee awards. This has created a legislative gray area, leaving soldiers unsure of their rights and whether their past employment will be honored in practice.

Financial Impact on Service Personnel

This is not merely an administrative technicality, as tenure directly dictates eligibility for jubilee awards, which consist of monthly base pay plus bonuses. For soldiers who entered the service later in life, the inability to count previous professional experience results in real financial disadvantages.

With the government aiming to expand the Polish Armed Forces to 250,000 soldiers, the treatment of recruits with significant private-sector backgrounds remains a pressing issue. The lack of a uniform policy leaves room for disparate interpretations by individual military units, further complicating the situation.
