The National Prosecutor’s Office has requested the European Parliament to waive the immunity of MEP Patryk Jaki regarding alleged abuses of power during his tenure as Deputy Minister of Justice.
Evidence of Malfeasance
The Regional Prosecutor’s Office in Poznań has compiled evidence suggesting that Patryk Jaki committed crimes while serving as Deputy Minister of Justice, specifically involving the Prison Service. Prosecutors allege that Jaki exceeded his powers and failed to fulfill his duties by issuing improper directives.
Illegal Promotion and Financial Gain
According to the prosecution, Jaki allegedly ordered the Director General of the Prison Service to promote a specific officer without meeting statutory requirements. These actions were reportedly intended to secure the official a higher position, increased salary, and guarantees of reinstatement after his secondment ended.
Undermining Public Interest
The prosecution states that these personnel decisions were made while the officer was under disciplinary investigation. These actions violated legal regulations, provided the official with undue personal and financial benefits, and undermined the integrity of the Prison Service’s personnel policy.
Procedural Necessity for Prosecution
As a sitting MEP, Jaki’s immunity must be lifted to formally present charges and proceed with the case. Prosecutors have also requested authorization for detention and forced appearance, citing procedural caution to prevent any potential obstruction of the investigation.
