Giertych Files Appeal Following Dismissal of “Two Towers” Investigation

The Warsaw District Prosecutor’s Office has closed its investigation into the “two towers” real estate project involving Gerald Birgfellner, prompting attorney Roman Giertych to announce a formal legal appeal.

Prosecutor’s Decision and Rationale

The Warsaw District Prosecutor’s Office announced on Tuesday the discontinuation of the “two towers” investigation. Spokesperson Piotr Antoni Skiba stated that detailed reasons for the decision will remain withheld until the resolution is translated into German.

Giertych Challenges Legal Integrity

Attorney Roman Giertych, representing Austrian businessman Gerald Birgfellner, criticized the decision and the management of the case. Giertych alleged that prosecutor Małgorzata Szeroczyńska, who oversaw the dismissal, has a history of questionable rulings regarding protest-related incidents and that her appointment was a calculated manipulation following the removal of prosecutor Ewa Wrzosek.

Allegations of Procedural Manipulation

Giertych argued that the replacement of Wrzosek was unprecedented and influenced by external pressures. He intends to pursue an appeal and expressed the view that systemic reform is required within the prosecutor’s office to ensure impartiality.

Legal Status of the Case

Unofficial reports from Radio Wnet suggest the case was closed under Article 17, paragraph 1, point 1 of the Code of Criminal Procedure, indicating that no crime was committed or that evidence was insufficient. The investigation, launched in February 2025, examined whether Gerald Birgfellner was misled into an unfavorable property arrangement involving the Srebrna company.

Background of the Two Towers Project

The investigation centers on failed plans to construct two skyscrapers on a plot owned by Srebrna, a firm linked to the PiS party. Jarosław Kaczyński testified as a witness in the case earlier this June, facing approximately nine hours of questioning.
