The Constitutional Tribunal is reviewing a dispute over the oath-taking of judges. The President’s Chancellery initiated the process, citing events from April 9th in the Sejm.
The dispute centers on whether the President or the Speaker of the Sejm has the authority to administer the oath to judges.
President Insists on Exclusive Oath-Taking Role
Zbigniew Bogucki, Head of the President’s Chancellery, stated that the President maintains that oaths must be taken exclusively before the head of state.
Oath-Taking Ceremony in the Sejm Sparks Conflict
On April 9th, four newly appointed judges took their oaths in the Sejm’s Column Hall, with the Speaker of the Sejm presiding over the ceremony.
President’s Office Claims Procedural Violation
The President’s Chancellery argues that official documentation indicates the Speaker, not the President, accepted the oaths, allegedly violating established procedures.
Two other Constitutional Tribunal judges previously took their oaths before the President.
Competency Dispute: President vs. Sejm Speaker
The core of the dispute lies in the interpretation of constitutional provisions. The President’s side asserts only the President can validly administer the oath to Constitutional Tribunal judges, while the Sejm Speaker’s actions suggest a differing interpretation allowing for parliamentary administration.
Bogucki emphasized that the Sejm oath-taking was perceived as an attempt to circumvent the President’s prerogatives.
National Prosecutor’s Office Launches Investigation
The National Prosecutor’s Office is also investigating the matter, having initiated an inquiry last week regarding the alleged obstruction of four Constitutional Tribunal judges from ruling.
The investigation was prompted by Justice Minister Waldemar Żurek and aims to determine if any laws were broken by preventing the judges from fulfilling their duties after taking their oaths.
