The trial of Antoni Zdzisław K. has commenced at the Kwidzyn District Court, following an indictment for the alleged rape of a minor committed between May and August 2009.
The Indictment
In December, the Toruń District Prosecutor’s Office filed an indictment with the Kwidzyn District Court. Investigators stated that the alleged crimes took place in Gdańsk and at the Danielówka forester’s lodge in Stary Dzierzgoń.
Prosecutors allege that the defendant, exploiting the emotional and social dependency of the victim, Magdalena N., committed acts of sexual intercourse against a minor under the age of 15 at least five times using violence and confinement.
Denial and Defense
Antoni Zdzisław K. has pleaded not guilty, claiming the prosecution’s findings are factually incorrect. He faces a potential sentence of two to twelve years in prison.
In a previous statement, the defendant denied the allegations, characterizing his relationship with the victim as “brotherly.” He described himself as a private citizen and requested that media outlets stop circulating claims he believes are part of a political vendetta against his father.
Procedural History
The Gdańsk District Prosecutor’s Office had initially investigated the matter but discontinued proceedings twice. The case was reopened following the 2023 parliamentary elections at the request of the victim.
Conflict with the Prime Minister
In April, Prime Minister Donald Tusk publicly accused the defendant of long-term pedophilia, claiming previous authorities had suppressed the investigation. Tusk linked the matter to the political influence of the defendant’s father, a prominent figure in the PiS party.
Legal counsel for Antoni Zdzisław K., Bartosz Lewandowski, announced that his client is suing the Prime Minister for these statements, demanding a public apology and 50,000 PLN in compensation. Lewandowski stated that a private indictment against the Prime Minister will also be filed, citing the presumption of innocence and the previous closures of the criminal investigation.
