14 Screwdriver Stabs: Court Finds Excessive Self-Defense in Fatal Altercation

The Ostrołęka Regional Court has sentenced Zbigniew G. to three years and six months in prison for the 2025 killing of his acquaintance, Marian Mirosław D., ruling that the defendant exceeded the limits of self-defense.

The Fatal Encounter

On May 10, 2025, in the municipality of Krzynowłoga Mała, Mazovian Voivodeship, an evening of drinking between long-time friends turned fatal. Following a dispute, the victim’s son discovered his father dead on the floor with multiple wounds and found the suspect, Zbigniew G., sitting on a nearby bed.

Police arrived to find the suspect intoxicated, with a blood alcohol level of approximately 1.2 per mille. Authorities seized the Phillips screwdriver used in the attack.

Investigation and Forensic Findings

A post-mortem examination determined that the direct cause of death was a massive external hemorrhage resulting from damaged spinal vessels. The pathologist identified 14 separate wounds of varying depths across the victim’s face and neck.

While the prosecution initially charged Zbigniew G. with intentional murder, the defendant denied the allegations, claiming he acted in self-defense after the victim attacked him first. Psychiatric evaluations confirmed the suspect was fully capable of understanding his actions at the time of the incident.

Court Ruling and Sentencing

On May 19, 2026, the Ostrołęka Regional Court issued its verdict, convicting the defendant of acting with eventual intent to kill but acknowledging the context of excessive self-defense. The court applied extraordinary mitigation to the sentencing.

Zbigniew G. received a three-year and six-month prison sentence. Furthermore, the court ordered the defendant to pay a total of 45,000 PLN in compensation to the victim’s family. The verdict is not yet legally binding.
